Five Key Legal Issues Associations Should Consider When It Comes to Generative AI
The use of artificial intelligence (AI) in businesses and organizations is becoming increasingly common, and a range of legal issues must be considered. Here are five key legal concerns identified by the ASAE that businesses should be aware of when implementing AI technology.
Intellectual property. Organizations that use AI must ensure that they are not infringing on the intellectual property rights of others. This can be particularly challenging given the complexity of AI algorithms and the lack of clear legal precedent in this area.
Data protection and privacy. The use of AI often involves the collection and processing of large amounts of data, which can raise significant privacy concerns. Organizations must ensure that they are complying with applicable data protection laws and regulations.
Liability. If AI technology causes harm or damage, who is liable? This is a particularly difficult question to answer given the often-complex nature of AI algorithms and the fact that they can evolve and change over time.
Bias and discrimination. AI algorithms can reflect the biases and prejudices of their creators, which can lead to discriminatory outcomes. Organizations must ensure that they are taking steps to identify and eliminate bias in their AI systems.
Transparency and explainability. AI algorithms can be opaque and difficult to understand, making it challenging to explain their decisions to stakeholders. Organizations must ensure that they are taking steps to make their AI systems more transparent and explainable.
